Welcome to Nexzeus.com ("Nexzeus.com" or the "Site"). Nexzeus ApS. and/or its affiliates ("Nexzeus") provide website features to you subject to the following conditions of use ("Conditions of Use"). If you visit or buy antivirus or related products at Nexzeus.com, you accept these Conditions of Use. Please read them carefully. In addition, when you use any current or future Nexzeus service or business (e.g., Nexzeus subscriptions, Nexzeus ACX) you will also be subject to the guidelines, terms and agreements ("Terms") applicable to such service or business. THE NEXZEUS SERVICE

The Nexzeus Service permits users to purchase proprietary licensed and original antivirus scanning services("Nexzeus Service") through various means (including the Site and any other domain names as may be operated, acquired, or used from time to time by Nexzeus, wired and wireless connections, and telephony based networks) You must be at least eighteen years old and have Internet access, a valid email address, and a valid credit card or check card to use the Nexzeus Service.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

Please review our other policies, such as privacy policy, which governs any purchase you may make from the Site, and the. We reserve the right to make changes to the Site, its policies, and these Conditions of Use at any time. Your continued use of this Site following any changes will indicate your acceptance of these changes. If you do not agree to any change to these Conditions of Use or any other policy posted on this Site, you must immediately stop using this Site. All software used on this Site is the property of Nexzeus or its software suppliers and protected by Danish and international copyright laws.

Nexzeus, Nexzeus.com, NexzeusScanner , and other Nexzeus.com graphics, logos, page headers, button icons, scripts, and service names are trademarks, registered trademarks or trade dress of Nexzeus in Denmark and/or other countries. Nexzeus's trademarks and trade dress may not be used in connection with any product or service that is not Nexzeus's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Nexzeus. All other trademarks not owned by Nexzeus that appear on this Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Nexzeus.

PATENTS

One or more patents owned by Nexzeus apply to this Site and to the features and services accessible via the Site. Portions of this Site operate under license of one or more patents.

LICENSE AND SITE ACCESS

Nexzeus grants you a limited license to access and make personal use of this Site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Nexzeus. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of Nexzeus.com so long as the link does not portray Nexzeus, or its products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any Nexzeus logo or other proprietary graphic or trademark as part of the link without express written permission.

HACKING AND SECURITY

We use a variety of means to protect the security of this Site. You agree not to attempt to access data or materials not intended for you, log into a server or account that you are not authorized to access, test the vulnerability of our network and security systems or otherwise breach or circumvent our security in any way. Although we attempt to prevent viruses and other malicious software from being passed along through this Site, you agree that protection of your own software, personal computer and other devices from malicious software is your responsibility and agree to install anti-virus and other security protections.

YOUR ACCOUNT

As a registered user of the Nexzeus Service, you may receive or establish one or more passwords and accounts ("Nexzeus Account"). If you use this Site, you are responsible for maintaining the confidentiality of your Nexzeus Account(s) and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under any of your Nexzeus Accounts. Nexzeus does not sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. If you are under 18, you may use Nexzeus.com only with involvement of a parent or guardian. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

You agree to ensure that all information you provide when registering for the Site or any offerings under the Nexzeus Service or when responding to requests for information from us will be current, complete, and accurate and you agree to maintain and update the information as required to keep it current, complete, and accurate. You agree not to use a false or misleading name or a name that you are not authorized to use. You agree that we may store and use information you provide (including credit card information) for use in maintaining your accounts and billing Nexzeus fees to your credit card.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

We may permit visitors to post reviews, comments, photos, and other content; send messages and other communications; and submit suggestions, ideas, comments, questions, or other information. You agree that any content you contribute and any communications you send using means we provide will not be illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." Nexzeus respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please take steps to contact us.

REMOVAL OF NEXZEUS CONTENT OR OTHER MATERIALS

We reserve the right to remove or disable access to any Nexzeus Content or any other materials posted to or otherwise displayed on the Site that violate or otherwise allegedly infringe on the copyright or other intellectual property, proprietary, or other rights of any person, company or other entity. We will in no event be liable for the good faith removal of or disabling of access to any such Nexzeus Content or materials under this Agreement.

NEXZEUS SERVICE DESCRIPTIONS

Nexzeus attempts to be as accurate as possible. However, Nexzeus does not warrant that Nexzeus Content or other product descriptions or content on this Site is accurate, complete, reliable, current, or error-free.

OTHER BUSINESSES

We may offer content from parties other than Nexzeus and may permit parties other than Nexzeus to provide services or sell products on the Site or in connection with the Nexzeus Service. TERMINATION

Nexzeus may at any time and at its sole discretion terminate your right to use this Site, the Nexzeus Service, and/or your Nexzeus Account if Nexzeus determines, in its sole discretion, that you have violated these Conditions of Use or any other policy posted on the Site or applicable to the Nexzeus Service.

TERMINATION OF NEXZEUS SERVICE

Our business will change over time and we reserve the right to modify, suspend or discontinue any service or any content we offer, in whole or in part, at any time, including the Nexzeus Service, with or without notice and without liability to you. In the event that we exercise such right, you may be entitled to a refund, in our sole discretion, if you are a member of an Nexzeus Plan (as defined in the Policy on Content Plans) or with respect to any purchase you've made.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

THE NEXZEUS SERVICE AND NEXZEUS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE NEXZEUS SERVICE AND NEXZEUS CONTENT, UNLESS OTHERWISE SPECIFIED IN WRITING IN ANY OTHER POLICY POSTED ON THIS SITE AND APPLICABLE TO THE NEXZEUS SERVICE. YOU EXPRESSLY AGREE THAT YOUR USE OF THE NEXZEUS SERVICE AND NEXZEUS CONTENT IS AT YOUR SOLE RISK.

NEITHER WE NOR ANY OF OUR SUPPLIERS OR LICENSORS WILL BE LIABLE TO YOU UNDER ANY CIRCUMSTANCES FOR ANY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES, ARISING IN CONNECTION WITH NEXZEUS SERVICES AND CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NEITHER WE NOR ANY OF OUR SUPPLIERS OR LICENSORS WILL BE LIABLE TO YOU UNDER ANY CIRCUMSTANCES FOR ANY DIRECT DAMAGES ARISING IN CONNECTION WITH NEXZEUS SERVICES AND CONTENT IN EXCESS OF THE GREATER OF: (A) THE PRICE PAID BY YOU FOR THE PARTICULAR SERVICE OR CONTENT GIVING RISE TO THE DAMAGE (IF APPLICABLE), OR (B) TWO HUNDRED FIFTY DOLLARS (US$250).

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

APPLICABLE LAW

By visiting Nexzeus.com or using the Nexzeus Service, you agree that the laws of the Danish Government, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Nexzeus.

DISPUTES

Except as otherwise specifically provided in the conditions of use applicable to an Nexzeus product or service, any dispute relating in any way to your visit to Nexzeus.com or to products or services sold or distributed by Nexzeus or through Nexzeus.com in which the aggregate total claim for relief sought on behalf of one or more parties exceeds $7,500 will be adjudicated in Danish court in Viborg, and you consent to exclusive jurisdiction and venue in this court.

NOTICES

We may provide notices to you by sending them to the email address associated with your account and our notice sent to you by email will be deemed received when sent. Any notice you have for us must be sent to the address below or to such other address as we provide in a notice to you or on this Site.

Nexzeus Purchase Terms and Conditions

In addition to the foregoing Nexzeus Site Conditions of Use, the purchase of Nexzeus Content on this Site is subject to the following additional Nexzeus Purchase Terms and Conditions. By purchasing any Nexzeus Content from the Nexzeus Site, you agree to be bound by these Nexzeus Purchase Terms and Conditions, which are subject to change by Nexzeus at any time, in its sole discretion. Changes to these Nexzeus Purchase Terms and Conditions will be effective when posted. Continued use of the Site and/or any purchase by you from the Site constitutes acceptance of the most recent version of these Nexzeus Purchase Terms and Conditions.

If you find a defect in Nexzeus Content, you may call Nexzeus customer service and Nexzeus will consult with you on proper downloading procedures and hardware requirements. If you are still unable to download a working copy of the Nexzeus Content or the Nexzeus Content is not as warranted above, Nexzeus will provide you with replacement Nexzeus Content or a credit on your Nexzeus Account, as determined by Nexzeus in its sole discretion, if you advise Nexzeus within 7 days of your first attempt to download the material by calling Nexzeus customer service or submitting the customer service request form available at the Site, provided you meet the registration, technical, and payment requirements for the Nexzeus Service.

THE FOREGOING WARRANTIES DO NOT COVER DEFECTS CAUSED BY VIRUSES, DISABLING CODES, ACCIDENT, MISHANDLING, MISUSE, IMPROPER INSTALLATION, SERVICE OR MAINTENANCE, MODIFICATION OF ANY NEXZEUS SOFTWARE OR NEXZEUS CONTENT OR THE MEDIA ON WHICH ANY NEXZEUS SOFTWARE OR NEXZEUS CONTENT ARE FURNISHED, OR THE USER'S LACK OF THE NECESSARY HARDWARE/SOFTWARE.

OTHER THAN AS EXPRESSLY PROVIDED ABOVE, WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE NEXZEUS SERVICE AND NEXZEUS CONTENT. YOU EXPRESSLY AGREE THAT YOUR USE OF THE NEXZEUS SERVICE AND NEXZEUS CONTENT IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY OF NON-INFRINGEMENT. NO NEXZEUS EMPLOYEE, AGENT, DEALER, DISTRIBUTOR, OR RESELLER IS AUTHORIZED TO MAKE ANY MODIFICATION OR ADDITION TO THE WARRANTIES STATED ABOVE.

Purchases of virus scan

General. If you purchase a virus scan from Nexzeus in connection with an Nexzeus Plan or special promotional offer, these terms apply to your purchase.
Product Descriptions. Nexzeus attempts to be as accurate as possible. However, Nexzeus does not warrant that product descriptions and related content are accurate, complete, reliable, current, or error-free. If a product offered by Nexzeus itself is not as described, your sole remedy is to return it in unused condition.
Pricing. Except where noted otherwise, the List Price displayed for virus scan and accessories on our website represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere.
Risk of Loss. All scans purchased from Nexzeus are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
Return Policy. Nexzeus will accept returns of devices for a refund within 30 days.

Notice And Procedure For Making Claims Of Copyright Infringement

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Nexzeus.com's copyright agent the written information specified below. Please note that this procedure is exclusively for notifying Nexzeus that your copyrighted material has been infringed.

An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
A description of the copyrighted work that you claim has been infringed upon;
A description of where the material that you claim is infringing is located on the Site;
Your address, telephone number, and e-mail address;
A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
